Privacy Statement

1. Introduction

ROXELL BVBA with its registered office at Industrielaan 13, 9990 Maldegem, Belgium and registered in the Crossroads Bank for Enterprises under enterprise number BE 0401 007 106 (hereinafter referred to as “we”, or “ROXELL”) places great importance on the secure, transparent and confidential collection and processing of your personal data. In particular, we want to protect the data from our clients, subcontractors and suppliers, and others, against loss, breaches, errors, unauthorized access or unlawful processing. We wish to inform you through this Data Protection Notice about the collection and processing of your personal data. We ask that you read this Data Protection Notice carefully as it contains essential information on how and why your personal data is processed. By sharing your personal data with us, you expressly acknowledge this Data Protection Notice and agree to it and you also expressly agree to the processing of your data. 

2. Scope

This Data Protection Notice relates to all services that we provide, and in general it relates to all activities that we perform. 

3. The controller and its obligations

ROXELL is the controller of your personal data. 
When we collect and process your personal data we respect Belgian legislation concerning the protection of personal data and also the General Data Protection Regulation (GDPR) as from its entry into effect on 25 May 2018.

4. Personal Data

Depending on your activities and your relationship with our company, you share the following personal data with us: your identity and contact data (name, title, address, email address, telephone and cell phone number). We would like to point out that you are responsible for all data that you provide us and that we trust the accuracy of this data. If your data is no longer up to date, please notify us by return of email. You are not obliged to share your personal data with us, but should understand that we will be unable to provide certain services or work together if you do not agree to the collection and processing of your personal data. 

5. Purposes of data processing and legal basis

5.1 Client data

We collect and process identity and contact data from our clients and commissioning parties, their personnel, employees, agents and other useful contact people in the course of our services. This data is processed for the purposes of performing agreements with our clients, client management, accounting, and public relations activities such as sending our newsletter or invitations to networking events. The legal bases for this are the performance of the agreement, compliance with statutory and regulatory obligations and/or our legitimate interest. You may withdraw at any time from the provision of information by email (such as newsletters or invitations to events). 

5.2 Supplier data

We collect and process the identity and contact data from our suppliers and their personnel, employees, agents and other useful contact people. We process this data for the purposes of the performance of this agreement, the management of suppliers/subcontractors, accounting, and public relations activities such as sending our newsletter or invitations to networking events. The legal bases for this are the performance of the agreement, compliance with statutory and regulatory obligations and/or our legitimate interest (such as for direct marketing). You may withdraw at any time from the provision of information by email (such as newsletters or invitations to events). 

5.3 Personnel data

We process the personal data of our employees as part of our personnel management and payroll administration. In view of its more specific nature, the processing of this data is regulated more extensively in our Data Protection Policy for employees. 

5.4 Website visitors

We only collect and process identity and contact data from visitors to our website when we request contact data as part of job applications and/or questions directed to ROXELL. This data is processed for the purposes of job applications and public relations activities. The legal bases for this are prior consent and/or our legitimate interest. 

5.5 Other data

In addition to data from clients, suppliers/subcontractors and personnel, we also process personal data from other parties, such as potential new clients/prospects, useful contacts in our sector, networking contacts, specialist contacts, etc. This data is processed in the interest of our activities and also public relations. The legal basis for this is our legitimate interest or in certain cases, the performance of an agreement. 

6. Duration of the data processing

We will store and process the personal data for the period of time required in accordance with the purposes of the data processing and in accordance with the relationship (which may or may not be contractual) that we have with you. In any event, we will remove client data and data from suppliers or subcontractors from our systems after a period of ten years following the end of the project, except where it concerns personal data that we have to store for longer under specific legislation, or in the case of an ongoing dispute for which we continue to require the personal data.  

7. Rights

In accordance with and pursuant to the terms of the Belgian privacy legislation and the provisions of the General Data Protection Regulation, we would like to inform you that you have the following rights: 

  • Right to access and inspection: you have the right to inspect the data that we hold on you at no cost and to check the purpose for which it is used.
  • Right to rectify: you have the right to have your incorrect personal data corrected, and also to supplement any incomplete personal data.
  • Right to remove or restrict data: you have the right to request that we delete or restrict the processing of your personal data under the circumstances and conditions provided in the General Data Protection Regulation. We may refuse to remove or restrict the processing of any personal data that we require to perform a legal obligation, perform the agreement or for our legitimate interest for as long as we require this data for the purposes for which it was collected. 
  • Right to transfer data (portability): you have the right to receive the personal data that you provided us in a structured and readable form. You have the right to transfer this data to another controller for processing.
  • Right to object: you have the right to object to the processing of your personal data due to serious or legitimate reasons. Please also take into account that you cannot object to the processing of personal data that we require to perform a legal obligation, perform the agreement or for our legitimate interest for as long as this data is required for the purposes for which it was collected.
  • Right to withdraw consent: If the processing of your personal data is based on prior consent, you have the right to withdraw your consent. This personal data will then only be processed if we have another legal basis to do so. 
  • Automated decision-making and profiling: we confirm that the processing of the personal data does not involve profiling and that you will not be subjected to automated decision-making.

We do everything possible to handle your personal data in a careful and legitimate manner that is in accordance with the legislation in force. Nevertheless, if you believe that your rights may have been infringed and your concerns have not been attended to within our company, you are free to submit a complaint to:

If you believe that you many suffer damage or loss as a result of the processing of your personal data, you may also take legal action. 

8. Transmission to third parties

Certain personal data that we collect will be transmitted to, and may be processed by, third-party service providers, such as our IT supplier, accountant, auditor and also the government. It is possible that one or more of the aforementioned third parties is located outside the European Economic Area (EEA). Furthermore, personal data will only be sent to third countries with an appropriate level of protection. 

The employees, managers and/or representatives of the aforementioned service providers or institutions and the specialized service providers which they appoint must respect the confidential nature of your personal data and may only use this data for purposes within the context they were provided.

If necessary, your personal data may be transmitted to other third parties. This may occur, for instance, if we undergo a partial or full restructure, if our activities are transferred or if we are declared bankrupt. It is also possible that personal data will have to be transferred in the event of a court order or to meet a certain legal obligation. In that eventuality, we will make reasonable efforts to inform you in advance about the sharing of your personal data with other third parties. You should also realize and understand that under certain circumstances this will not always be technically or commercially feasible, or that legal restrictions may apply.

 We will not sell your personal data or make it available commercially under any circumstances to direct marketing companies or similar service providers, unless we have your prior consent.

9. Technical and organizational measures

We take the necessary technical and organizational measures to process your personal data with a satisfactory level of security and to protect this data against destruction, loss, falsification, changes, unauthorized access or unintentional disclosure to third parties and also every other form of unauthorized processing of this data.

ROXELL cannot be held liable under any circumstances for any direct or indirect loss arising from an incorrect or unlawful use of the personal data by a third party.

10. Access by third parties

We grant our employees, collaborators and agents access to your personal data with a view to the processing of your personal data. We guarantee a similar level of protection by making contractual obligations enforceable against these employees, collaborators and agents which are similar to this Data Protection Notice.
